1. Overview and scope

This Privacy Policy explains how MyCleverly, operated by Mycleverly Services, collects and processes personal data when you visit the website, create an account, buy or sell digital learning content, use videos, ebooks, quizzes, live training, community tools, support, or MyCleverly AI.

This policy applies to learners, visitors, creators, instructors, business customers, school or team administrators, parents, educators, and other people who interact with MyCleverly. It should be read together with our Terms of Use, Payments, Refunds and Billing Policy, Cookie Policy, MyCleverly AI Policy, and Creator and Marketplace Terms.

MyCleverly is a U.S. service. If you access the platform from outside the United States, your information may be processed in the United States and other countries where our service providers operate, subject to the safeguards described in this policy.

Mycleverly Services is the business or controller responsible for deciding how MyCleverly processes personal data, unless a separate written agreement states otherwise.

3. Personal data we collect

We collect account data such as name, email address, username, password credentials or authentication tokens, profile photo, preferred language, country, role, course preferences, accessibility preferences, and account settings.

We collect learning activity such as courses viewed, videos watched, ebooks opened, quizzes attempted, answers submitted, scores, progress, certificates, enrollments, downloads, bookmarks, notes, messages, live session attendance, support tickets, and feedback.

We collect marketplace and creator data such as creator profile, biography, credentials, course descriptions, pricing choices, payout and tax information, revenue share data, reviews, moderation history, and communications with learners.

We collect payment-related data such as transaction identifiers, purchased products, prices, currency, coupons, billing country, invoices, refund status, chargeback information, fraud signals, and payment processor references. Full card numbers should normally be handled by payment processors, not stored by MyCleverly.

We collect technical data such as IP address, device identifiers, browser, operating system, pages visited, referrers, approximate location, logs, diagnostic events, security events, cookie identifiers, consent choices, and interaction data.

When you use MyCleverly AI, we may process prompts, uploaded files, course context, user language, learning preferences, AI outputs, feedback, safety flags, and interaction metadata needed to provide, secure, and improve the assistant.

4. How we use personal data

We use personal data to provide the platform, maintain accounts, deliver digital content, process videos and ebooks, administer quizzes, issue certificates, run live training, process payments, provide refunds, pay creators, send receipts, and provide support.

We use data to personalize learning, recommend courses, remember preferences, translate content, display progress, identify relevant learning paths, rank marketplace results, and help users discover content.

We use data to provide MyCleverly AI, generate educational responses, maintain limited conversation context, prevent misuse, evaluate output quality, detect safety issues, and respond to AI-related support requests.

We use data to secure the platform, detect fraud, prevent account takeover, investigate chargebacks, enforce policies, moderate content, protect intellectual property, comply with law, and respond to lawful requests.

We use data for analytics, product improvement, performance monitoring, debugging, research, accessibility improvements, financial reporting, tax compliance, creator reporting, trust and safety operations, and business administration.

5. Legal bases for European users

For users in the European Economic Area, United Kingdom, Switzerland, or similar jurisdictions, we rely on legal bases such as performance of a contract, legitimate interests, consent, compliance with legal obligations, and protection of vital interests where applicable.

Contract processing includes account creation, course access, payments, refunds, creator services, certificates, support, and delivery of digital learning content. Legitimate interests include platform security, fraud prevention, service improvement, analytics, abuse detection, marketplace integrity, and basic business communications.

Consent may apply to non-essential cookies, certain marketing messages, certain AI or profiling settings, and specific permissions requested in the interface. You can withdraw consent where the law allows.

6. AI prompts, files, and learning context

Do not include passwords, payment card details, government identifiers, private health data, confidential employer information, trade secrets, or personal data of another person in MyCleverly AI prompts unless you have permission and a lawful basis.

We may process prompts, files, outputs, and feedback to operate the AI feature, maintain conversation history, prevent abuse, improve safety, resolve support issues, and measure quality. The recommended production default is not to use private learner prompts, private files, or private course interactions to train public AI models unless the user clearly opts in or the data has been robustly de-identified.

AI service providers may process prompts and outputs as service providers or processors under their contracts. MyCleverly should configure providers to minimize retention, restrict provider training on private customer data where available, and apply confidentiality and security safeguards.

7. How we share personal data

We share data with service providers that help operate MyCleverly, including hosting, storage, content delivery networks, payment processors, fraud prevention vendors, analytics tools, email providers, support tools, video processing, transcription, translation, AI infrastructure, monitoring, security, accounting, and legal compliance providers.

We may share limited learner data with creators when necessary to deliver a course, answer questions, manage cohorts, support live training, evaluate course performance, or comply with marketplace obligations. Creators must use learner data only for permitted educational and support purposes.

We may share account, progress, enrollment, and certificate data with an employer, school, team, or organization if your account is managed by that organization.

We may disclose data to comply with law, enforce terms, protect rights, investigate fraud or abuse, respond to lawful requests, complete a corporate transaction, or protect users, creators, MyCleverly, or the public.

8. Sale, sharing, targeted advertising, and profiling

MyCleverly does not sell personal data for money. Some privacy laws define sale, sharing, targeted advertising, or profiling broadly to include certain advertising, analytics, or cross-context behavioral advertising technologies involving cookies, pixels, or identifiers.

If MyCleverly enables advertising or retargeting technologies that qualify under applicable law, the platform should provide required opt-out controls, honor legally required browser-based opt-out signals, and connect the controls to the cookie banner and privacy choices page.

Course recommendations, ranking, personalization, fraud scoring, moderation, and AI assistance may involve automated processing. MyCleverly should provide meaningful information and choices where required by law.

9. International transfers

Because Mycleverly Services is located in the United States, data may be processed in the United States and other countries that may not provide the same level of protection as your country.

For transfers from the EEA, United Kingdom, or Switzerland, MyCleverly should rely on appropriate safeguards such as Standard Contractual Clauses, UK transfer mechanisms, adequacy decisions, data processing agreements, vendor due diligence, and supplementary security measures where required.

10. Retention

We retain personal data for as long as needed to provide the service, maintain accounts, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, support security, maintain financial records, and honor user choices.

Learning records may be kept while your account is active so you can resume courses, retain certificates, access purchases, and maintain progress. Payment, invoice, tax, refund, fraud, and accounting records may be kept longer where required by law or legitimate business needs.

Deleted content may remain in backups for a limited period. We may retain de-identified, aggregated, or anonymized data that no longer identifies a specific person.

11. Your privacy rights

Depending on where you live, you may have rights to access, correct, delete, export, restrict, object to, or opt out of certain processing of personal data. You may also have the right to withdraw consent, appeal a decision, lodge a complaint, or limit the use of sensitive data.

To exercise privacy rights, contact support@mycleverly.com with enough information to identify your account and request. We may verify your identity and may deny or limit requests where allowed by law, such as when retention is required for security, legal, tax, fraud, or transactional reasons.

12. Children and minors

MyCleverly is not intended for children under 13 unless a specific school, parent, or child-directed implementation has been reviewed and configured for compliance with applicable children privacy laws.

If we learn that we collected personal data from a child under 13 without required consent, we will take reasonable steps to delete it. Parents or guardians may contact support@mycleverly.com to request review or deletion.

13. Security, changes, and contact

We use administrative, technical, and organizational safeguards designed to protect personal data. No online service is completely secure, and users are responsible for using strong passwords and promptly reporting suspected unauthorized access.
