1. Creator role and independence

Creators are independent content providers, not employees, agents, partners, or legal representatives of MyCleverly. Creators are responsible for their courses, descriptions, pricing choices where available, communications, claims, and compliance obligations.

MyCleverly may review, approve, reject, rank, promote, translate, moderate, remove, or suspend creator content to protect learners, comply with law, enforce policies, or maintain marketplace quality.

2. Course quality and claims

Creator content must be accurate, lawful, educational, reasonably complete, clearly described, and not misleading. Titles, thumbnails, claims, prerequisites, outcomes, difficulty level, language, and refund-related statements must match the delivered product.

Creators should maintain reasonable audio and video quality, readable slides, accessible documents, working downloads, updated links, clear explanations, and support for material course errors.

Creators must not promise guaranteed jobs, guaranteed income, guaranteed exam success, official certification, medical results, legal results, immigration outcomes, or financial performance unless properly qualified and supported by evidence.

3. Creator intellectual property

Creators retain ownership of their lawful course content. By publishing on MyCleverly, creators grant MyCleverly a license to host, stream, display, reproduce, distribute, market, translate, subtitle, index, recommend, and otherwise make the content available through the platform.

Creators represent that they own or have licensed all videos, audio, images, fonts, slides, code, datasets, ebooks, music, trademarks, and third-party materials used in their content.

4. Learner data

Creators may receive limited learner information needed to deliver the course, answer questions, manage live sessions, support cohorts, analyze course performance, or comply with marketplace rules.

Creators must not export, sell, spam, retarget, or use learner data outside MyCleverly unless the learner clearly agrees or law and MyCleverly rules allow it.

5. Payouts, taxes, and reserves

Creator payouts depend on revenue share rules, refunds, chargebacks, taxes, payment processor fees, promotions, affiliate fees, subscription allocation, currency conversion, and fraud review.

MyCleverly may hold reserves, delay payouts, offset negative balances, request tax forms, verify identity, or suspend payouts where needed for compliance, refund exposure, fraud, chargebacks, sanctions, or policy violations.

6. Moderation and no circumvention

Creators must not use MyCleverly to move learners to off-platform purchases, avoid platform fees, collect unauthorized payments, share direct download links outside allowed features, or solicit reviews or refunds outside platform rules.

MyCleverly may issue warnings, request edits, remove content, reduce visibility, disable enrollment, suspend creator accounts, withhold payouts, refund learners, or terminate creator participation for policy violations.
